FEEL LUCKY PRODUCTIONS is referred to in these Terms as “Oops We Scaled”, “we”, “us” or “our”.
These Terms govern the use of the Oops We Scaled website, its free tools and its professional services.
2. Our Services
Oops We Scaled provides online tools, analytics and professional services designed to help businesses better understand Amazon profitability and advertising performance.
The website currently provides or may provide:
• Amazon Profit & PPC Calculator
• Performance Snapshot
• AI Performance Insights
• What If? Simulator
• Professional PPC Audit
• Amazon PPC Management
• related professional consulting services
The Calculator, Snapshot, AI Performance Insights and What If? Simulator are currently provided free of charge.
Paid professional services are arranged separately.
3. Professional Use of Paid Services
Paid Oops We Scaled services are intended exclusively for persons acting for business or professional purposes.
This includes, for example: Amazon sellers, brands, companies, agencies, consultants, entrepreneurs and other professional users.
The Professional PPC Audit and PPC Management services are not offered for personal or household use.
By submitting a request for a paid professional service, the requester confirms that the request relates exclusively to their business, trade or professional activity.
Nothing in these Terms excludes a mandatory legal protection that cannot lawfully be excluded.
4. Free Tools
The following features are currently available free of charge:
• Amazon Profit & PPC Calculator
• Performance Snapshot
• AI Performance Insights
• What If? Simulator
No payment is currently required to access these features.
We may modify, improve, limit, replace or discontinue free features in the future.
5. Calculations, AI and Estimates
Calculator outputs, performance scores, AI-generated analysis, recommendations and What If? scenarios are based on the information entered by the user.
Outputs may use mathematical calculations, predefined business rules, automated systems and artificial intelligence.
Results may contain inaccuracies, omissions or assumptions and may not reflect every cost, fee or circumstance affecting the user’s actual Amazon business.
AI-generated analysis has not been independently reviewed by a human unless we expressly state otherwise.
Scenario results are estimates only and are not guaranteed predictions of future performance.
Users remain responsible for verifying their inputs, reviewing the outputs and making their own business decisions.
6. No Professional Financial Advice
Oops We Scaled provides business analytics and advertising-related information.
The website and its outputs do not constitute legal, accounting, tax, financial, investment or other regulated professional advice.
Users should consult qualified professionals where appropriate.
7. No Guarantee of Results
We do not guarantee increased sales, revenue or profit, lower ACoS or TACoS, improved ROAS, lower CPC, improved conversion rates, improved organic ranking, Buy Box eligibility or ownership, reduced Amazon fees, successful advertising campaigns, business growth or any specific commercial or financial outcome.
Amazon performance depends on many circumstances outside our control, including competition, pricing, inventory, advertising auctions, customer demand, Amazon policies, marketplace changes and third-party actions.
8. Professional PPC Audit
The Professional PPC Audit is a one-time personalized professional service.
The standard price currently displayed on the website is $29, unless a different price is clearly agreed before the service is ordered.
Submitting the “Request My PPC Audit” form does NOT create a paid order, charge the requester, guarantee acceptance of the request, or automatically create an obligation for Oops We Scaled to perform the Audit.
After reviewing the request, we may accept the request, request additional information, decline the request, or propose a different scope where appropriate.
If the request is accepted, payment and invoicing instructions will be sent separately.
Unless otherwise agreed, work begins only after: (1) the request has been accepted; (2) payment has been received; (3) all information reasonably required to perform the Audit has been received.
The Audit is normally delivered within 3–5 business days after these conditions have been satisfied.
The Audit does not include ongoing campaign management, implementation, listing changes, creative production or unlimited revisions unless agreed separately.
9. Amazon PPC Management
Amazon PPC Management is a separate professional service.
The website may display: Starting at $499/month. This is an indicative starting price only.
Final pricing and scope may depend on factors including marketplace, number of ASINs or products, advertising spend, account complexity, number and type of campaigns, reporting requirements and additional services.
Submitting a PPC Management inquiry does not create a service contract.
A management engagement begins only after scope, pricing and applicable commercial terms have been agreed in writing.
A separate proposal, order form, statement of work or service agreement may apply. Where a specific written agreement conflicts with these Terms, that specific agreement will take precedence for the relevant engagement.
10. Contract Formation for Paid Services
Submitting an inquiry through the website is not a binding purchase.
For a Professional PPC Audit, a paid engagement is formed when Oops We Scaled accepts the request, the applicable price and scope have been communicated, these Terms have been made available, and the customer accepts the engagement, including through payment of the corresponding invoice where payment constitutes acceptance.
For PPC Management, the contract is formed according to the applicable proposal, order form or service agreement.
11. Prices and Taxes
Professional PPC Audit: $29 one-time. Amazon PPC Management: starting at $499/month.
Prices may change for future engagements. The final price applicable to a paid professional service is the amount stated on the relevant invoice, proposal or order confirmation.
Applicable VAT and other taxes are determined according to the customer’s location, tax status and applicable law. The applicable tax treatment will be stated on the relevant invoice where required.
No discount, rebate or early-payment discount applies unless expressly agreed or stated on the invoice.
12. Payment and Invoicing
Paid professional services are currently invoiced separately through FEEL LUCKY PRODUCTIONS’ external invoicing or accounting process.
No self-service payment checkout is currently required through the Oops We Scaled website.
Unless another deadline is stated on the invoice or agreed in writing, invoices are payable according to the payment terms stated on the invoice.
For a Professional PPC Audit, payment is normally required before work begins.
Customers must provide accurate billing information where requested, including where applicable legal or business name, billing address, country and VAT or tax identification number.
13. Late Payment – Professional Customers
Where a professional invoice is not paid by its due date, late-payment penalties become payable automatically from the day following the due date, without prior reminder.
Unless another lawful rate is stated on the invoice, the applicable late-payment rate will be determined according to applicable French law.
A statutory fixed recovery-cost indemnity of EUR 40 may also become payable for each overdue professional invoice. Additional documented recovery costs may be claimed where legally permitted.
14. Cancellation and Refunds – PPC Audit
A Professional PPC Audit may be cancelled before substantive work begins.
If payment has already been received and substantive work has not begun, the amount paid will normally be refunded in full.
Once substantive work has begun, the service is generally non-refundable, except where we agree otherwise, we are unable to provide the agreed service, or applicable mandatory law requires otherwise.
If Oops We Scaled cancels an accepted Audit before delivery, any amount paid for the undelivered service will be refunded.
15. PPC Management Cancellation
Cancellation terms, notice periods, billing periods and any minimum commitment for PPC Management are defined by the specific proposal or service agreement applicable to that engagement.
16. Customer Responsibilities
Users and customers are responsible for providing accurate and complete information, ensuring they are authorized to provide submitted data, reviewing calculator inputs, reviewing reports and recommendations, making final business decisions, complying with Amazon policies and complying with applicable laws.
Users must not submit through the website Amazon passwords, primary Seller Central login credentials, complete payment-card details, unnecessary sensitive personal data, or confidential information they are not authorized to disclose.
17. Amazon Account Access
Where Amazon account access is required for a separately agreed professional service, access should be provided through Amazon’s authorized user-permission, partner or agency-access functionality where available.
Customers should not share their primary Amazon account password. The customer remains responsible for the permissions granted.
18. Confidential Business Information
We use reasonable care to protect non-public business information provided for the purpose of performing a Professional PPC Audit or PPC Management service.
Such information may be shared with technical service providers only where reasonably necessary to provide the service or where disclosure is required by law.
Personal data is handled according to our Privacy Notice.
19. Intellectual Property
The Oops We Scaled website and its original software, calculator, reports, analysis structure, text, graphics, branding, designs, workflows and other original content are owned by or licensed to FEEL LUCKY PRODUCTIONS.
Users may use reports and outputs generated for them for their own internal business purposes.
Without prior written permission, users may not resell our reports as their own commercial product, systematically reproduce the Service, scrape the website, circumvent access controls, reverse engineer the application, or commercially redistribute substantial parts of our original content.
Users retain the rights they hold in the information they submit.
20. Service Availability
We aim to maintain reliable access to the website but do not guarantee continuous, uninterrupted or error-free operation.
Availability may be affected by maintenance, hosting providers, database providers, artificial intelligence providers, email providers, network failures, security incidents, third-party systems and circumstances outside our reasonable control.
21. Third-Party Services
Oops We Scaled may rely on third-party technical providers for hosting, databases, artificial intelligence functionality, email delivery and other infrastructure.
Personal-data processing involving those providers is described in our Privacy Notice.
Oops We Scaled is not responsible for Amazon’s systems, policies, availability or business decisions.
22. Limitation of Liability
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
To the fullest extent permitted by law, Oops We Scaled is not responsible for indirect or consequential business losses arising from inaccurate information supplied by the user, reliance on estimates, reliance on AI-generated analysis, business decisions made by the user, Amazon policy or algorithm changes, advertising-auction changes, or failures of third-party systems.
For professional customers, our total contractual liability relating to a specific paid professional service is limited, to the extent permitted by law, to the total amount paid to FEEL LUCKY PRODUCTIONS for that specific service during the twelve months preceding the event giving rise to the claim.
This limitation does not apply to liability that cannot lawfully be limited.
23. Amazon Independence
Oops We Scaled and FEEL LUCKY PRODUCTIONS are independent from Amazon. They are not affiliated with, sponsored by, approved by or endorsed by Amazon.com, Inc. or any of its affiliates.
Amazon, Amazon Ads, Amazon Advertising, Seller Central, FBA and related names and trademarks belong to their respective owners.
References to Amazon are used only to describe the intended context of our tools and professional services.
24. Personal Data
Personal data is processed according to the Oops We Scaled Privacy Notice.
The Privacy Notice explains what information is collected, why it is processed, applicable retention periods, service providers and user rights.
Submitting a Professional PPC Audit or PPC Management inquiry does not automatically subscribe the requester to marketing communications.
25. Electronic Communication
Customers agree that communications relating to requests, invoices, reports and professional services may be exchanged electronically, including by email.
Customers are responsible for providing and maintaining a valid email address.
26. Force Majeure
Neither party will be responsible for a delay or failure caused by an event beyond its reasonable control that qualifies as force majeure under applicable French law.
27. Changes to These Terms
We may update these Terms to reflect changes to the website, services, technology, business model or applicable law. Changes apply prospectively.
A paid professional service already contracted remains subject to the version of the Terms applicable when that engagement was entered into, unless otherwise agreed or required by law.
28. Governing Law
These Terms and paid professional services are governed by French law.
The parties will first attempt in good faith to resolve any disagreement amicably.
29. Jurisdiction
FOR CONTRACTS BETWEEN PARTIES ACTING AS COMMERCIAL PROFESSIONALS, AND WHERE SUCH A JURISDICTION CLAUSE IS LEGALLY VALID, ANY DISPUTE THAT CANNOT BE RESOLVED AMICABLY SHALL BE SUBJECT TO THE COMPETENT COURTS OF BORDEAUX, FRANCE.
THIS CLAUSE DOES NOT APPLY WHERE APPLICABLE MANDATORY LAW REQUIRES ANOTHER COURT TO HAVE JURISDICTION.
30. Language
These Terms are available in English and French. Both versions are intended to describe the same contractual conditions.
In the event of a discrepancy, the French version will prevail to the extent permitted by applicable law.
